Legal
Terms and Conditions
These Terms and Conditions (the “Terms”) are the contract between you and SPECIALX GIFT PRINTING INC for anything you buy from legitphonydl.com. They set out what you are buying, what we promise, what we do not promise, and what happens if something goes wrong.
1.These Terms
These Terms apply to every order placed through the Website https://legitphonydl.com, operated by SPECIALX GIFT PRINTING INC (the “Company”, “we”, “us”, “our”). By placing an order you confirm that you have read them, that you accept them, and that you have the legal capacity to enter into a contract.
They should be read together with our Legal Notice and Conditions of Use, our Privacy Policy and our Shipping & Returns page, which form part of the contract. If there is a conflict between these Terms and any other document, these Terms prevail on matters of sale, and the Shipping & Returns page prevails on the specific mechanics of delivery, returns and refunds.
We may update these Terms from time to time. The version that applies to your order is the version published on the Website at the moment you place it, and a copy is available on request. Changes published afterwards do not affect orders already confirmed.
2.Eligibility
You must be at least eighteen years old, and legally able to enter into a binding contract, to place an order. If you order on behalf of a business, you confirm that you are authorised to bind that business, and “you” in these Terms refers to both you personally and the business.
We may ask for proof of age or identity where an order gives us reason to, and we may decline or cancel an order where that proof is not provided.
3.Accounts
You may order as a guest or open an account. If you open an account you are responsible for keeping your password confidential, for all activity that occurs under it, and for telling us immediately if you believe it has been used without your authorisation.
You must supply accurate, current and complete information, and keep it up to date. We may suspend or close an account that contains false information, that is used to abuse promotions, or that is associated with fraudulent orders or chargebacks.
4.Products and descriptions
The products we sell are novelty printed goods: custom novelty cards, prop and costume identification cards, badges, gift cards, printed keepsakes and related print items. Photographs, mock-ups, illustrations and sample images on the Website are for guidance. Slight variation in colour, tone, positioning, weight and finish is inherent to printing and does not constitute a defect.
We try to describe every product accurately, but we do not warrant that descriptions, images, dimensions or colours are error-free, complete or current. Where a product is materially different from its description, the remedies in the Shipping & Returns page apply.
5.Artwork, proofs and approval
Where an order requires artwork, you may upload your own file or supply text and instructions for us to lay out. Files must meet the specifications published on the Website: resolution, colour mode, bleed, trim size and format. Files that do not meet them may produce a lower-quality result, and we are not responsible for that result where the file was supplied by you.
Before printing a customised order we send a digital proof. You are responsible for checking it: spelling, numbers, dates, photograph quality, layout, colour and trim. Approval of the proof is your authorisation to print, and once you approve it the content is final. Errors present in an approved proof are not our responsibility, and a reprint required because of them is charged at our standard rate.
If you do not respond to a proof within seven calendar days, we send one reminder. If there is still no response after a further seven days, we hold the order and contact you; after thirty days without a response we may cancel the order and refund the value of the goods, less any work already performed.
6.Nature of the products and acceptable use
The goods we produce are novelty and prop items. They are not issued by any government or authority, they carry no legal effect, and they must not be presented as official documents or used to obtain any benefit, service, age verification, entry, credit or identity. They are supplied for novelty, costume, film, television, photography, theatre, collection and gift purposes.
By placing an order you confirm that you will not use the goods to deceive any person or authority, that you will not alter them to appear official, and that you accept sole responsibility for the use to which they are put once delivered. You further confirm that you hold the rights necessary in any name, photograph, logo, trademark or design you ask us to print, and that printing it does not infringe the rights of any third party.
We may refuse or cancel an order, at our discretion and without liability, where the content requested appears to infringe a third party’s rights, to impersonate a real person or a public authority, or to breach the content rules in section 17. Where we refuse an order for that reason we refund it in full.
7.Orders and acceptance
An order placed through the Website is an offer to buy. Our order confirmation email acknowledges receipt of that offer; the contract is formed when we send a second email confirming that production has been accepted, or when we dispatch the goods, whichever happens first.
We may decline an order where the product is unavailable, where the price or description was published in error, where payment is not authorised, where we suspect fraud, where the delivery address cannot be verified, or where the content breaches section 17. If we decline after payment has been taken, we refund it in full.
8.Prices, currency and taxes
Prices are shown in United States dollars and are exclusive of shipping unless stated otherwise. The total payable, including shipping and any applicable sales tax, is displayed at checkout before you confirm payment. That total is the price you pay.
Sales tax is applied where we are required to collect it, based on the delivery address. Import duties, value-added tax and customs charges on international orders are the recipient’s responsibility, as explained in the Shipping & Returns page.
We may change prices at any time, but a change never affects an order already confirmed. Where a price was published in obvious error — a decimal point misplaced, a figure clearly inconsistent with the product — we may cancel the order and refund you rather than honour the erroneous price.
9.Payment
We accept the payment methods displayed at checkout, which may include major credit and debit cards and third-party payment services. Payment is taken when the order is placed, not at dispatch.
Card payments are processed by a third-party provider on a secure page. We do not receive or store your full card number or security code. By submitting payment details you confirm that you are authorised to use the payment method, and you authorise us to charge the total shown.
Where a payment is declined, the order is not confirmed and production does not begin. Where a payment is later reversed or charged back without a legitimate reason, we may suspend the order, recover the goods, and suspend the associated account.
10.Promotions and discount codes
Discount codes are personal, single-use unless stated otherwise, cannot be combined unless the promotion says so, and cannot be applied to an order already placed. Codes have no cash value and expire on the date published.
We may withdraw a promotion, or cancel orders that used a code obtained fraudulently or used in breach of its conditions, refunding any amount actually paid.
11.Production and delivery
Production and transit times are set out in the Shipping & Returns page. They are estimates given in good faith, not guaranteed dates, and they exclude customs clearance and carrier delays outside our control.
Where a delay is caused by us and exceeds ten business days beyond the estimated dispatch date, you may cancel the order for a full refund, whether or not production has begun. Where the delay is caused by the carrier, by customs, or by an event of force majeure, we assist you in resolving it but are not liable for the delay itself.
Delivery is complete when the carrier records delivery at the address supplied, or when the parcel is collected from the collection point indicated.
12.Risk and title
Risk in the goods passes to you on delivery. Title in the goods passes to you when we have received payment in full, including any shipping charge.
13.Cancellation and changes
You may cancel or change an order at no cost before production begins, provided the proof has not been approved. Requests must be made in writing to [email protected] and are effective when we confirm them by email.
Once production has begun, the order cannot be cancelled, because the goods are manufactured to your specification. Changes requested after production has begun may be accepted at our discretion, at additional cost, and only where the production stage still allows it.
14.Returns, refunds and warranty
The return and refund rules are set out in full in the Shipping & Returns page, which forms part of these Terms. In summary: damaged, defective or incorrect items are replaced or refunded at our cost when reported within 48 hours of delivery; personalised items are not returnable once the proof has been approved, except where defective; and change-of-mind returns are accepted within fourteen days of delivery on unused items in their original packaging, with return postage paid by you.
Nothing in these Terms excludes or limits any right you have under mandatory consumer protection law in your place of residence. Where such a right gives you more than these Terms do, that right prevails.
15.Our intellectual property
The Website, its design, its text, its photographs, its product mock-ups, its templates and its software are owned by the Company or licensed to it, and are protected by intellectual property law. You may not copy, reproduce, distribute, resell or create derivative works from them without our prior written authorisation.
Designs, templates and layouts that we create are licensed to you for the order in which they are delivered. The licence is personal and non-transferable. It does not permit resale of the design as a file, use of the design for a different product, or sharing it with third parties for their own production.
16.Your content and the licence you grant us
You retain ownership of the artwork, photographs, text and logos you send us. By sending them you grant the Company a non-exclusive, royalty-free licence to store, reproduce, modify as necessary for production, print and deliver them, for the sole purpose of fulfilling your order and complying with our legal obligations.
You confirm that you own the content or hold all permissions needed to have it printed, and that its use by us for your order does not infringe any copyright, trademark, design right, privacy right or other right of any person. You accept responsibility for any claim brought by a third party in relation to that content.
We keep production files for ninety days after delivery, in case a reprint is needed, and then delete them. We do not use your content for our own marketing unless you give separate written permission, and we do not sell it.
17.Content we will not print
We will not print content that, in our reasonable judgement:
infringes the copyright, trademark, design right or other intellectual property of a third party;
reproduces the name, seal, emblem, signature or layout of a real government, agency, police force, armed force or official body in a form intended to pass as genuine;
impersonates a real, identifiable person without their permission, or misuses their photograph;
is defamatory, obscene, hateful, or sexualises minors in any way;
promotes violence, terrorism, or the exploitation of any person;
contains malware, or instructions for causing harm.
Where we refuse content, we tell you why in general terms and refund the order in full. Refusal of one order does not affect any other order you may place.
18.Indemnity
You agree to indemnify and hold harmless the Company, its directors, officers, employees and contractors against any claim, loss, liability, cost or expense — including reasonable legal fees — arising from content you supplied, from your breach of these Terms, or from your use of the goods after delivery in a manner contrary to section 6.
19.Disclaimer of warranties
Except as expressly stated in these Terms, the goods and the Website are provided “as is” and “as available”, without warranty of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Website will be available without interruption or free of error, that defects will be corrected, or that the Website or the servers that make it available are free of viruses or other harmful components. We take reasonable measures to prevent them, but no system is perfectly secure.
20.Limitation of liability
To the maximum extent permitted by law, the Company is not liable for indirect, incidental, special, consequential or punitive damages, nor for loss of profit, loss of revenue, loss of opportunity, loss of reputation or loss of data, arising from the use of the Website or from the goods supplied.
To the maximum extent permitted by law, our total liability arising from any order is limited to the amount you paid for that order. This limit does not apply to liability for death or personal injury caused by our negligence, to fraud, or to any liability that cannot lawfully be limited.
21.Force majeure
We are not liable for any failure or delay in performing our obligations caused by an event beyond our reasonable control, including natural disaster, fire, flood, epidemic, war, civil disturbance, strike, government action, carrier failure, customs action, power outage, or failure of a telecommunications or payment network.
Where such an event occurs, we notify you as soon as reasonably possible, we extend the affected deadlines for its duration, and if it continues for more than thirty days either party may cancel the affected order, with a full refund of any amount paid for goods not delivered.
22.Governing law and dispute resolution
These Terms are governed by the law of the United States and by the law of the state in which the Company is incorporated, without regard to conflict-of-law rules. Before any formal proceedings, both parties agree to attempt to resolve the dispute in good faith: write to [email protected] with a description of the issue and the outcome you are seeking, and we will respond within fifteen business days.
If the dispute is not resolved within thirty days of that first written notice, either party may bring proceedings before the state or federal courts sitting in the county of the Company’s registered office. Nothing in this section prevents you from bringing a claim in the courts of your place of residence where mandatory consumer law gives you that right.
23.General provisions
Severability: if any provision of these Terms is held invalid or unenforceable, it is modified to the minimum extent necessary to make it enforceable, and the remaining provisions stay in full force.
No waiver: a failure or delay by us in exercising a right is not a waiver of that right, and a single or partial exercise does not prevent further exercise.
Assignment: you may not assign or transfer your rights under these Terms without our written consent. We may assign our rights to a successor in connection with a merger, acquisition or sale of assets.
Entire agreement: these Terms, together with the Legal Notice and Conditions of Use, the Privacy Policy and the Shipping & Returns page, constitute the entire agreement between you and the Company in relation to their subject matter, and replace any prior understanding.
Language: these Terms are drafted in English. Where a translation is published for convenience, the English version prevails in case of discrepancy.
24.Contact
Questions about these Terms, an order, or a claim: [email protected]. Include your order number, and allow one business day for a reply. Written notices should be addressed to SPECIALX GIFT PRINTING INC at the registered office published in section 1.1 of the Legal Notice and Conditions of Use.
